Tuscan Gardens Zoning Information

Tuscan Gardens next zoning meeting --

The next Zoning commission meeting is June 3rd.

We are making progress with the help of code enforcement getting Tuscan Gardens to correct all there violations.  Hedges are being put in now.  But we still need all homeowners to send in once again comment cards to  BGoldberg@pbcgov.org.  Tell them we do not want two 50 feet tall building towering over our community. 

We are happy to see that homeowners are doing there part to beautify their  homes and keeping Aspen Ridge looking so pristine!  We had our last two homes sell in Aspen Ridge within 48 hours!  

 

May 3, 2021

We are scheduled for the zoning hearing on Thursday, May 6th.  We are still negotiating with Tuscan Gardens.  They have fixed the sidewalks that they broke in front, but are still in violation of code enforcement regarding the landscaping.  We still do not want 2 four story buildings looking in our back yards.  We still want Tuscan Gardens to put in a wall or fence around our community which abuts their property.  We want extra landscaping.  We want to make sure that Tuscan Gardens works with critter control for any rat or snake infestation due to their building. 

We are asking every homeowner who abuts Tuscan Garden’s to take pictures of your backyard fences (if you have one).  If any of these fences come down it will be their responsibility to repair or put a new fence up.

We are also concerned about lighting on Sims Road, there are no lights presently and with extra traffic, this is a dangerous issue.

The developer is trying to postpone the rezoning hearing set for Thursday, until May 6th.  Our counsel feels that the pressure that Aspen Ridge is putting on them is having an effect.  The Commission could deny their postponed request, so our counsel will be in attendance for Aspen Ridge.  If you were planning to attend in person, please do not, as we may need everyone for May 6th

TO ALL ASPEN RIDGE RESIDENTS:

 

Please be advised that the zoning comment cards (which were sent out yesterday) do not have an Agenda Item No.  We are working to ascertain the Agenda Item No. so the comment cards can be sent to AMcdonald@pbccgov.org. The zoning notice and the comment cards are for Aspen Ridge Community homeowners and others to complete in opposition to Phase 2. The comment cards will only be accepted from March 25 until March 30.  The Comment Cards maybe confusing to send out now and then follow up with the agenda item number or wait and risk having limited time. Please feel free to send these cards in with or without the agenda number.  Public opposition to phase 2 is the most important aspect of this entire process and the Comment Cards will make it easier for those that cannot attend.   

 

The Community should consider including some of its general themes in a cover letter when sending the cards to members. Feel free to add, delete or amend any of these:

 

1.  For Phase 1 approval the developer made many promises to the Association, after its approval the developer sought amendments to its approval without notice to the members and broke its promises.  Phase 1 looks horrible and is negatively impacting the Association. The promises made in Phase 1 should be kept before moving onto Phase 2.

 

2.  The developer will not agree to fulfill its Phase 1 promises without the Association's approval of Phase 2.

 

3.  The 50ft allowable height of the buildings in Phase 2 will be an eye sore.  

 

4.  Phase 2 has no safeguards for the Association regarding privacy or landscaping.  The proposals by the developer are insufficient to safeguard the owners and their privacy. 

 

5.  The lighting on Sims Rd is horrible and the increased traffic from these new developments is making the situation dangerous. The developer should be required to make lighting improvements to Sims Rd as a condition of approval.
